Dino orders parliamentarians to be held responsible for amendments

Minister Flávio Dino, of the Federal Supreme Court (STF), decided this Wednesday (29) that the Chamber of Deputies and the Senate must present to the Court a matrix of responsibilities for controlling parliamentary amendments.

The decision was taken after the minister analyzed successive reports from the Comptroller General of the Union (CGU), the Federal Audit Court (TCU) and the Federal Police (PF) which highlighted the recurrence of irregularities in the execution of amendments.

According to the decision, the Chamber and the Senate must provide information to the Supreme Court about the indications for amendments. The statement must contain a proposal for a matrix of responsibilities, which must contain the identification of the agents involved in all stages of payment of the amendments.

Furthermore, the minister stated that the proposal must also ensure that the parliamentarian who authored the individual amendment is responsible.

For Dino, the issue of amendments involves a constitutional issue and goes beyond the "discretionary territory of politics".

"Use of public money is subject to criteria governed by the Federal Constitution, comprising the due constitutional budgetary process. To say more obviously: indicating a Pix amendment is not the same as passing on a Pix to a family member or a corner business", stated Dino. The minister also gave a deadline for a statement from the Presidency of the Republic, through the Attorney General's Office (AGU), and the Attorney General's Office (PGR).

The impasse over the release of the amendments began in December 2022, when the STF understood that the amendments called RP8 and RP9 were unconstitutional. After the decision, the National Congress approved a resolution that changed the rules for distributing resources through rapporteur amendments to comply with the Court's determination.

However, PSOL, the party that filed the lawsuit against the amendments, pointed out that the decision continued to be in non-compliance.

After the retirement of Minister Rosa Weber, the original rapporteur of the case, Flávio Dino took over the management of the case.
