SÃO PAULO, SP (FOLHAPRESS) - The Public Ministry of the State of São Paulo archived the police investigation opened to investigate an alleged crime of ideological falsehood on the part of the president of the São Paulo Deliberative Council, Olten Ayres.

The leader had been indicted by the Civil Police on the 23rd, as part of an investigation that began following a request from the São Paulo Ethics Commission.

In a report dated April 29, the collegiate pointed out that he could have committed the crime of ideological falsehood and ordered that the document be forwarded to the authorities.

The suspicion stemmed from an opinion from the Advisory Council used in the club's statutory reform proposal. The document was presented as official, but the police concluded that the body never met to discuss the issue. For the police, the simulation served to legitimize the eventual reform, which constitutes an ideological falsehood.

The demonstration for archiving was signed by prosecutor Daniela Domingues Hristov, from the 4th Criminal Justice Prosecutor's Office of the Capital. After analyzing the facts and elements gathered in the investigation, she concluded that there was no just cause for filing a complaint.

"The Public Prosecutor's Office itself acknowledged that there was no proof of the existence of the crime and that the document investigated did not have content capable of producing legal effects that would justify criminal prosecution", declared lawyer Jair Jaloreto, responsible for Olten Ayres' defense.

The lawyer also informed that the director's defense will await the completion of the archiving process, in accordance with criminal procedural legislation.
