Court orders São Paulo city hall to release Uber Moto

The case was judged by judge Patrícia Persicano Pires, from the 16th Public Finance Court of São Paulo. She rejected the reasons presented by the municipal body to prevent the service from operating.

If the decision is not complied with, the city hall is subject to a daily fine of R$5,000, which can reach, for now, a ceiling of R$500,000. The municipality can appeal. The use of motorcycles to transport passengers was banned in the city of São Paulo in 2023. The impediment came through a decree signed by Mayor Ricardo Nunes. According to him, the modality presents risks for passengers due to the high rates of accidents involving motorcycles in the capital.

Since then, Uber has been in a legal dispute over the use of motorcycle taxis. The company turned to the National Urban Mobility Policy, which, in its understanding, authorizes the modality in the country. 99 stopped offering the service.

In a note, Uber highlights that, “in the decision, the judge highlighted the contradictory behavior of the municipal administration in raising last-minute bureaucratic questions about the insurance declaration, such as the lack of signature, which had not been questioned in previous stages and which go beyond what had already been judged”.

The company also reaffirmed its commitment to the safety of users and service providers. The city of São Paulo has not yet sent Agência Brasil a position regarding the court's decision.
