SÃO PAULO, SP (UOL/FOLHAPRESS) - The São Paulo Court of Justice reduced the sentence of Paulo Cupertino Matias from 98 to 90 years in prison for the murder of actor Rafael Miguel and his parents.

The 10th Criminal Law Chamber of the TJSP reduced the defendant's punishment. The decision, taken unanimously last Thursday (23) and published today, corrected the dosimetry and limited the sentence for each qualified homicide to 30 years.

Although it maintained the aggravating factors recognized in the sentence, the court concluded that the punishment for each crime could not exceed the maximum of 30 years provided by law. As the sentences for the three deaths were added together, the sentence fell from 98 to 90 years.

The case's rapporteur, judge Rachid Vaz de Almeida, rejected all requests for annulment presented by the defense. Cupertino lawyers alleged irregularities, such as failures to preserve evidence in the accused's office and restriction of defense.

The court also maintained the material competition, a situation in which the penalties are added. The Court understood that Cupertino carried out individual actions against three different people and discarded the requests for recognition of a formal competition or continued crime.

The crime happened because Paulo Cupertino did not accept his daughter, Isabela, dating actor Rafael. On the day of the crime, the defendant surprised the victims at the door of the residence and shot all three of them, who died instantly.

The court decision highlighted the brutality of the action and the devastating impact on the victims' families. The rapporteur stressed that the murders were committed in the presence of Cupertino's daughter and left an orphan, Rafael's sister, a teenager.

After the crimes, the defendant fled and remained hidden for almost three years using false documents. During the process, it was proven that he received help worth R$5,000 from accomplices to escape the police.

A brother from Cupertino removed the image recorder from the accused's office shortly after the murders. A witness's testimony confirmed that Joel disappeared with the device, refuting the thesis of a failure in the police investigation.

Two men admitted to having helped Paulo Cupertino flee the city shortly after the murders. Wanderley Antunes Ribeiro and Eduardo José Machado helped the accused with bank deposits and logistical support to escape.
