According to the representation of the Military Public Ministry (MPM), the soldier hid from his former companions that he was HIV positive.
According to the organization, he used his status as a soldier to convey confidence and assure the victims that he carried out periodic health checks. Based on the rapporteur vote, Minister José Barroso Filho, the STM plenary agreed with the accusations' arguments and understood that the soldier violated the ethical and moral principles of the corporation, in addition to compromising class decorum and the image of the Army.
In the defense presented to the court, the soldier's lawyers stated that the conduct concerns the accused's private life and is not related to his role in the Army.
In addition to the military process, the soldier was also sentenced by ordinary courts to six years in prison for very serious bodily injury.
