In the questioned posts, the park's profile mentions, in “collab” posts, major sporting events and country shows with captions thanking former governor Mauro Mendes (União) and governor Otaviano Pivetta.
The PL questioned five posts, however, the preliminary decision granted the request for suspension of only two. In other cases, the magistrate saw no irregularities.
“On the other hand, still in preliminary court, I identify that the publications, whose caption by the event director thanks the Defendant [Pivetta] as a public agent, with reference to the public work – Parque Novo Mato Grosso, currently pre-candidate, and other pre-candidate public agents, even without mentioning the electoral context, violate the electoral norm”, decided the judge.
“This is because, § 2 of article 15, item VI, paragraph “b” of TSE Res. No. 23,735/2024 establishes that institutional advertising is proven, in addition to other elements, by the indication of names that allow the identification of authorities, governments and administrations whose positions are in dispute, a situation present in the case when the profile @parquenovomt publishes, even through third parties, the name of pre-candidates on its official profile, linking them to government actions. It is important to highlight that the illegality in the electoral scenario is apparently evident, in kind, by the fact that the disclosure is included in the @parquenovomt profile”, explained the judge, then.
The magistrate set a daily fine of R$1,000 in case of non-compliance.
It also ordered the summons of Otaviano and Wener to present a defense in electoral representation.
