Son-in-law and daughter of agricultural billionaire are investigated by the police

The investigations are part of Operation False Flag, launched in 2023, and were shared with the State Attorney General's Office (PGE), serving as the basis for an Incident of Disregard for Legal Personality (IDPJ) filed by the State of Mato Grosso.

The action, filed last year, targets the companies Producampo Indústria e Comércio de Cereais Ltda., Producampo Transportes Rodoviários Ltda., Producampo Agroindustrial Ltda., Rodopar Transportes Rodoviários Ltda. and Agro Pampa Comércio de Cereais Ltda., in addition to Nivaldo Almeida Santiago, Nivaldo Sanches Santiago, Ana Lúcia de Morais, Rayssa Modolon Scheffer Santiago, Nayara Morais de Oliveira, Nayara Sanches Santiago Nabarrete and Cristian Thelmo Morais Garcia de Lima.

According to a report obtained by MidiaNews, investigations point to evidence that the Producampo Group used shell companies, family members and employees to move assets, hide assets and irregularly reduce the tax burden.

According to the Civil Police, all of the group's companies would be controlled by Nivaldo Almeida Santiago; his wife, Ana Lúcia de Morais; the son, Nivaldo Sanches Santiago; and Nayara Morais de Oliveira, daughter of Ana Lúcia.

The main focus of the investigation is alleged fraud in the use of tax incentives granted by the Mato Grosso Industrial and Commercial Development Program (Prodeic).

According to the Civil Police, companies linked to the group had issued invoices simulating operations with industrialized products to cover loads of soy and corn that had not undergone the processing required by law.

As a result, according to investigations, the tax burden would have been reduced from 12% to 1.8%, through the improper use of the presumed credit provided for in the state program.

According to the report, the scheme would only have been possible because the group used a network of companies registered in the name of family members, employees and third parties, allowing the issuance of tax documents and the circulation of resources between legal entities without operational autonomy.

In the request to disregard the legal personality, the State Attorney General's Office states that the Producampo Group's debt amounts to approximately R$238 million, a value that could approach R$250 million with the incidence of interest and fines.

Apartment worth R$3.1 million

Rayssa's name appears in the investigation due to the purchase of a high-end apartment in the Apogeo Building, in Cuiabá. Valued at around R$3.1 million, the property was registered exclusively in her name.

According to the police report, however, part of the resources used in the acquisition would have been paid by Nivaldo Sanches Santiago or by companies linked to the Producampo Group.

Among the documents analyzed, the Civil Police identified a payment of R$ 125 thousand made by Agro Pampa Comércio de Cereais Ltda. — former Farol Agroindustrial — directly to Plaenge Empreendimentos Ltda., responsible for the project.

Furthermore, messages extracted from Nivaldo Sanches' cell phone would indicate concern about keeping the apartment registered only in his wife's name, so that the property would not appear in asset searches related to possible legal proceedings or bank charges.

Rayssa and Nivaldo got married in a luxurious ceremony on July 12, 2023

The purchase and sale contract signed between Rayssa and Plaenge is dated March 29, 2022 and establishes the value of R$3,118,600 for the apartment.

Another aspect highlighted by the investigators is that the marriage between Rayssa and Nivaldo, celebrated under the total separation of assets regime, only took place on July 12, 2023, more than a year after the signing of the purchase contract.

“Furthermore, Technical Report No. 2024.5.325249, produced within the scope of IP 191/2019/DEFAZ, presents strong evidence that Rayssa Modolon Scheffer Santiago was used to hide the name of Nivaldo Sanches Santiago from the transaction of the ‘Apogeo’ property before the construction company, with the likely objective that he would not appear as part of this transaction in the registry office or in the Federal Revenue Service”, says an excerpt from the report.

Despite being mentioned in the investigation, Rayssa does not appear as a partner in the main companies of the Producampo Group nor is she identified as a member of the central nucleus of the alleged criminal organization.

Its inclusion results from the analysis of the purchase of the apartment and the origin of the resources used in the acquisition.

The report also highlights that Grupo Bom Futuro is not the target of the investigation and that Rayssa's relationship with the company is exclusively family.

Heritage confusion

The Civil Police also points to signs of property confusion involving Rayssa and companies from the Producampo Group.

According to the report, she received R$70,000 from the company Rodopar Transportes Rodoviários Ltda.

Investigators also identified that, on February 22, 2024, Rayssa transferred R$600,000 to Nivaldo Sanches Santiago. On the same date, he transferred exactly the same amount to Producampo Indústria e Comércio de Cereais Ltda.

A few days later, on February 28, 2024, Producampo credited R$603,000 to Nivaldo's account, who then returned R$600,000 to Rayssa.

In addition to these movements, the report records two other transfers made by Rayssa in favor of Nivaldo, on different dates, totaling R$52,931.22.

The Civil Police investigation remains ongoing, with the analysis of the seized material. The action filed by the State Government is being processed in secret.
