TCU proposes to Congress to increase salaries by up to 40% after releasing super salaries outside the ceiling

The proposal foresees an annual impact of R$27.7 million from 2027 and the largest bonus reaches R$12.13 thousand. Penduricalho is a popular designation for extra funds, such as bonuses, aid and compensation added to the base salary, which are excluded from the calculation of the constitutional salary ceiling for civil servants.

The sending of the project, the text of which was obtained by Folha, expands a movement by the court to increase the remuneration of its civil servants who perform functions of trust. Also on Wednesday (15), the ministers decided that the portion received for holding leadership and management positions must be subject to the ceiling separately from the salary for the permanent position.

In practice, the change allows the final remuneration to exceed the constitutional limit in situations in which the bonus is currently absorbed by the so-called ceiling reduction.

The decision contradicted the opinion of the technical area of the court itself and met a demand defended by Congress leaders, such as the president of the Senate, Davi Alcolumbre (União-AP), who pressured TCU ministers for this decision, as Folha revealed last week. For a member of the court of accounts, who spoke on condition of anonymity, the decision opened the way for a new super penduricalho.

Under the project, which is signed by the president of the TCU, Vital do Rêgo, the highest bonus (FC-8) would rise from R$8,987 to R$12,133, while the lowest (FC-1) would go from R$1,554 to R$2,176. The adjustment reaches the 913 trust functions existing in the court structure and would produce financial effects from January 2027. The level with the largest amount of extra funding is FC-3 with 313 bonuses. The value for this group will rise from R$3,930.84 to R$5,503.18, if the project is approved.

In the explanatory memorandum, the court states that the amounts currently paid are out of date compared to the Chamber, Senate and Executive. The court maintains that the update is necessary to make leadership positions more attractive, retain qualified employees and adapt remuneration to the increased complexity of activities performed by the body, such as inspections of large contracts, governance, digital transformation and information security. When contacted by Folha, TCU's advisors did not provide additional comments.

The TCU also argues that the proposal does not create new functions or expand the structure of the court, limiting itself to recomposing the values currently provided for by law, and states that the expense is compatible with its budgetary and financial capacity.

This week's TCU decision began to take effect immediately.

Also on Wednesday (15), the director general of the Senate, Ilana Trombka, ordered compliance with the ruling from the July payroll, with payment in a supplementary payroll. The order, obtained by Folha, determines that the Personnel Management Secretariat calculates the financial impact of the measure and forwards the values ??for analysis of budgetary availability before releasing the resources.

Last Wednesday (18), the minister-rapporteur, Walton Alencar Rodrigues, voted not to take the representation of the union of Congress and TCU employees forward. Dean of the TCU, he stated that union entities "are not legitimized to represent the court, as per the exhaustive list provided for in the TCU's internal regulations." However, he was defeated by the other eight ministers who participated in the trial.

The trial took place months after a decision by Minister Flávio Dino, of the STF, which reorganized the treatment of funds paid to the judiciary and the Public Ministry. Supreme Court ministers saw the TCU's decision as a setback in the debate.

Behind the scenes, the TCU's decision was seen as the court's response to President Luiz Inácio Lula da Silva's (PT) veto of the project that aimed to increase the salaries of court employees.

In the explanatory memorandum of the law sent to Congress this week, Vital do Rêgo said that the "disparity" between the salaries of court technicians and Congress "was aggravated by the partial veto of the project, specifically in the provisions where the successive correction of the court's trust functions was foreseen, which prevented the implementation of the policy of staggered updating of trust functions then proposed".

"The occupants of these functions assume responsibilities that transcend the duties inherent to permanent positions, being responsible for leading highly specialized teams, managing relevant institutional risks and delivering results that directly impact the quality of control exercised by the Court", wrote the president of the TCU in the explanatory memorandum.

The TCU has permission to send bills on its own organization, operation, creation of positions and remuneration of its employees directly to the National Congress.
