(FOLHAPRESS) - Created in 1966, after the end of job stability, the FGTS (Service Time Guarantee Fund) came into force in 1967. Currently, it is one of the main funds in the country, considered a worker's savings and used to finance home ownership and basic sanitation works.

The fund corresponds to a monthly deposit made by the employer equivalent to 8% of the salary of the employee hired under the CLT (Consolidation of Labor Laws) regime. Money can only be withdrawn in specific situations, such as retirement, dismissal and purchase or amortization of home equity payments.

The FGTS profit began to be distributed by Caixa Econômica Federal in 2017, based on the result obtained in 2016. This year, workers will receive R$13.042 billion, equivalent to 89% of the profit recorded in 2025.

Last year, the Guarantee Fund had a positive result of R$14.7 billion. With the distribution, the profitability of the accounts will be 6.90%, which represents a real gain of 2.53% above inflation measured by the IPCA (Broad National Consumer Price Index), which closed 2025 at 4.26%.

The income also complies with the decision of the STF (Supreme Federal Court) in ADI (Direct Action of Unconstitutionality) 5,090.

The credit represents an increase of 1.87% on the balance of each account. To calculate how much they will receive, the worker can apply this index to the total amount available in December 2025.

Anyone who had R$1,000, for example, will receive R$18.68. For a balance of R$100 thousand, the amount distributed will be R$1,868.34.

Check out what they are:

1. Dismissal without just cause The worker can withdraw the FGTS balance when he is dismissed without just cause. In this modality, you also receive a termination fine of 40% of the amount deposited by the employer. In case of dismissal by agreement, the fine drops to 20%.

2. Retirement Anyone who retires can withdraw their entire available balance. If you continue working at the same company, you can also withdraw the new deposits made by the employer.

3. Purchase or construction of your own home The balance can be used to purchase or build a residential property, as long as the requirements set out in the legislation are met, such as minimum contribution time to the FGTS and absence of another property under the established conditions.

4. Amortization or settlement of real estate financing The worker can also use the resources to reduce the outstanding balance, reduce the value of the installments or pay off the financing of their own home.

5. End of temporary contractEmployees hired for a fixed term are entitled to withdrawal when the employment relationship comes to an end.

6. Birthday withdrawal Anyone who has subscribed to this modality can withdraw part of the balance every year, in the month of their birthday. On the other hand, you lose the right to full withdrawal in the event of unfair dismissal, keeping only the termination fine.

7. Bankruptcy of the company or death of the employer Termination of the contract due to the bankruptcy of the company or the death of the individual employer also allows the withdrawal of amounts.

8. Reciprocal fault or force majeure When the Labor Court recognizes the fault of both parties or characterizes a situation of force majeure, the withdrawal may be authorized.

9. Public calamity, natural disasters and emergency situations Residents of municipalities affected by floods, landslides or other situations officially recognized by the public authorities can have access to the fund balance.

10. Suspension of casual work Casual workers can withdraw the FGTS when activities are suspended for at least 90 days.

11. Death of the worker Qualified dependents or heirs are entitled to withdrawal upon presentation of the required documentation.

12. Age 70 or over Upon turning 70, the account holder can request the withdrawal of funds.

13. HIV or cancer treatment Withdrawal is also allowed when the worker or one of his dependents is a carrier of the HIV virus or is undergoing cancer treatment.

14. Serious illness or terminal stagePatients with serious illnesses provided for by legislation, or in a terminal stage, can also withdraw the FGTS balance, including when the illness affects a dependent.

15. Three consecutive years without employment under the FGTS regime Anyone who remains unemployed for three consecutive years with a formal contract can withdraw the available balance, respecting the rules established for release.
