The decision rejected the request for reconsideration made by Club de Regatas Vasco da Gama. Vasco president Pedro Paulo de Oliveira, better known as Pedrinho, remains removed from command of the SAF.
The previous intervener resigned, citing a lack of minimum personal security conditions to hold the position.
The Court maintained the precautionary removal of three members of the Board of Directors and reaffirmed the competence of the State Court to supervise the judicial recovery, rejecting the argument that the dispute should be resolved exclusively via the Arbitration Court.
Judge Simone Gastesi Chevrand, from the 6th Business Court of the Capital, took over management of the case. One of the intervenor's roles is to ensure that management is conducted "in order to return to the administration of the Club de Regatas Vasco da Gama those who were elected for this purpose, or even adopt measures aimed at the subsequent convening of a deliberative assembly of new management", stated the judge in the decision.
The judge clarified that there is no legal impediment to the sale of SAF shares to new investors, as the work of exempt professionals and the transparency of procedures can add security and attract interested parties in the market, guaranteeing the economic viability of the judicial recovery project.
