Bolsonaro's defense requests the return of Flávio's visits and claims that his son is his father's lawyer

In the document, the former president's lawyers argue that the senator is accredited as part of Bolsonaro's defense and that, therefore, Moraes cannot prevent the two from maintaining contact as it is Flávio's professional prerogative.

They also argue that "criminal execution cannot lose sight of the fact that the preservation of family ties is part of its own purpose."

Moraes banned meetings between Flávio and Bolsonaro for 90 days, a period that lasts until after the first round of elections. The minister stated that the senator failed to comply with the precautionary measure that prohibits Bolsonaro from using social networks, directly or through third parties, by publishing a letter from his father.

Last Friday (17), the minister maintained Bolsonaro's house arrest despite non-compliance with the restrictive measure, but expanded the restrictions, such as the right to visit family members for 30 days, political contacts until the October elections and the publication of new manifestos.

The regulatory appeal (type of appeal) presented by the former president's defense asks for authorization for Flávio's visits as a family member, "as the restriction imposed is disproportionate given the specific circumstances of the case." They repeat that Bolsonaro did not know about the publication of the letter.

If the request is denied, the lawyers will request Moraes' approval for the senator to have direct contact with the father as a lawyer. In case of a general denial, they ask that the case be analyzed by the First Panel, which also includes Flávio Dino (president), Cristiano Zanin and Cármen Lúcia.

"The appealed decision ends up imposing a restriction that goes beyond the limits of necessity, adequacy and proportionality, proving to be excessive both by limiting family life in a situation that does not reveal enough gravity to justify a consequence of this intensity, and by having repercussions, without specific legal basis, on the communication between the appellant and one of the lawyers", he says.

As Folha showed, the restriction imposed by Moraes should have an impact on Flávio's pre-campaign. The suspension period will end on October 11th. The lack of contact with the former president could make it difficult to coordinate decisions regarding his pre-candidacy and Bolsonarism platforms.

The senator's pre-campaign has already activated the OAB (Brazilian Bar Association) and is betting on the entity's request to the Supreme Court so that the right to communication between the client -in this case Bolsonaro- and the defense -exercised by Flávio- is guaranteed.
