To appeal the initial decision, the company maintained in the case that it already adopts a facial biometrics system in accordance with federal legislation and the rules of the Prizes and Betting Secretariat of the Ministry of Finance. It also alleged that the first instance decision went beyond legal requirements, invaded the jurisdiction of the federal regulator and was issued by a court without the competence to impose a measure of national scope. On the other hand, the judge who analyzed the company's appeal stated that online betting platforms require a high level of security to prevent access by minors and stated that the simple possibility of failures in the verification mechanisms constitutes a defect in the provision of the service. According to the decision, the existence of technical certifications does not prove the infallibility of the systems used by the platform. The decision also rejected the allegation of incompetence of the Children and Youth Court of Campina Grande to issue a measure with effect throughout the country. The first decision According to the first decision, the suspension should take place within 48 hours under penalty of a daily fine of R$100,000 until the company regularizes the mechanisms for blocking websites for minors. The suspension is valid for the entire national territory and also for platforms that are owned by Pixbet, such as Flabet and Bet da Sorte Among the measures initially imposed by the Court for the regularization and resumption of the platforms are: facial recognition with proof of life for each access and each financial transaction; biometric cross-verification with official databases; automatic blocking of registrations made using minors’ CPF.

In addition to the insufficiency of age verification mechanisms, the judge of the first decision was based on the understanding that the platforms use elements that have a strong appeal to children and young people, such as visual resources, online casino games, including the so-called "Jogo do Tigrinho", and advertising associated with the sports universe. In the initial decision, the judge states that these elements contradict the principle of full protection of children and adolescents, provided for in the Federal Constitution, the Child and Adolescent Statute (ECA), Law No. 14,811/2024, known as "ECA Digital", and the Bets Law. When justifying the national scope of the initial decision, the judge highlighted at that time that the platforms operate over the internet, which, according to him, makes it impossible to restrict the effects of the measure to Paraíba only. The judge also cited the understanding of the Federal Supreme Court (STF) that allows public civil actions of this nature to be effective throughout the national territory.
