In the decision, the rapporteur stated that no blatant illegality was demonstrated that would justify granting the emergency measure. After the arrest, the defense informed the court that Peixoto is available to carry out the examination and asked that the examination be carried out urgently. For the rapporteur, however, as the arrest took place on July 15th and the request to carry out the examination has not yet been analyzed by the execution court, there are no elements to grant house arrest at this time. As a result, the injunction request was denied. The merits of habeas corpus will still be analyzed by the Court after a statement from the Attorney General's Office.
