The measure partially responds to a request from the Solidariedade party, which contested the change in the House's internal regulations. The parliamentarian assumed the interim presidency of Aleam on April 4 of this year, after the departure of Roberto Cidade (União Brasil). Cidade left the position to take over the Government of Amazonas, after the simultaneous resignations of the then governor Wilson Lima (União Brasil) and the vice-governor, Tadeu de Souza (Progressistas). In June, the Assembly approved an amendment to the Internal Regulations that allowed the vice-president to permanently assume the presidency in the event of a vacancy in the position, without the need for a new election. ? In the preliminary injunction, Flávio Dino determined that Aleam follows the Internal Regulations of the Chamber of Deputies, which provides for an election for a vacancy on the Board of Directors when the position becomes vacant before the end of the second year. The decision suspends the article of Legislative Resolution No. 1,159/2026, which allowed the vice president to assume the presidency in any type of absence or vacancy. What the decision says When partially granting the precautionary measure, Flávio Dino stated that there were signs that the change disrespected due legislative process due to a lack of thematic relevance between the original project and the amendment that dealt with the succession of Aleam's presidency. According to the minister, the Constitution requires that parliamentary amendments be related to the theme of the original proposal, under penalty of compromising the transparency and legitimacy of the legislative process. In his assessment, the change represents a possible “jabuti amendment”. Dino also highlighted that the change was approved after the presidency of the Assembly became vacant, producing immediate effects on an already existing concrete situation. In practice, the standard used as a reference provides for an election to be held to fill a vacancy on the Board of Directors when the position of president becomes vacant before the end of the second year of the term. The decision, however, does not set a date for the vote to take place, it only determines that Aleam adopt this procedure. According to the Chamber's rules, the election must take place within up to five sessions of the House. The decision was granted on a preliminary basis and becomes effective immediately. However, it will still be submitted to the STF plenary, which must decide whether or not to endorse Minister Flávio Dino's measure. In the decision, Flávio Dino also determined that the Legislative Assembly promote, in the next legislature, a review of the Internal Regulations to permanently regulate cases in which the position of president becomes vacant, observing due legislative process.
