The time of grief is one of the most vulnerable periods in anyone's life. In addition to the pain of loss, there is also financial insecurity. To clarify the rules on death pensions, the Union of Lawyers of the State of Alagoas (Sindav/AL) issues a warning on the subject, pointing out myths that keep people away from legitimate benefits. Brazilian legislation protects the right of partners to request the death pension benefit, even without the so-called "past paper". Cohabitation under the same roof can be proven through documentary and circumstantial evidence, such as utility bills, records of children in common, insurance policies or health plans where the partner is listed as a dependent, and even photos, and witnesses that prove life in a stable union. According to Limmerck Pacifico Dantas, general secretary of Sindav/AL, all death pension rules are defined in Law No. 8,213/91, and go beyond documents registered at a notary's office. "Social security law comes to support the population and not to create invisible obstacles. Knowing the rules, and not taking myths as truth, guarantees autonomy in seeking a pension from the INSS. The legislation protects the reality of the facts, and not just the formalism of a notary's office. People need to know the legislation so that no one is left helpless at the time when they most need stability", stated the general secretary of Sindav/AL, a specialist in social security law. Myths about remarriage and lack of registration at a registry office Ascom Sindav/AL Another myth is that the widow or widower loses the right to a death pension if they remarry. But the legislation guarantees that a new marriage does not extinguish the right to a death pension already granted. The prohibition is to accumulate two pensions due to the death of different spouses, in these situations, the person must choose. Elias Ferreira, president of Sindav/AL, reinforces the need for every citizen to have basic knowledge of the legislation to be able to fight for rights. "Information is our greatest social protection tool. Lack of knowledge can generate irreparable emotional and financial losses. When Sindav/AL brings these clarifications, we are shielding families against misinformation. Knowing that a new marriage does not cut the benefit or that a stable union can be recognized brings peace of mind.
