The defense claims that the change was a form of retaliation. The defense also maintains that the disclosure of the case occurred on the day of the launch of Malu's pre-candidacy for state deputy and classifies the episode as political gender violence. In the petition presented to the Court, the lawyers also claim that the businessman had provided information and images of the process to the press in a "selective and distorted" way. The requests will still be analyzed by the Judiciary. The parliamentarian's defense also denies that she invaded or damaged her ex-partner's residence. According to the lawyers, the images only show the councilor circulating in common areas of the condominium and do not prove the damage attributed to her. In the request presented to the Court, the defense requests that the protective measures be expanded to prohibit Mario Luiz Moreno Junior from disclosing images or information about the councilor and requests that, in the event of further non-compliance, his preventive detention be ordered.

Protective measure The protective measure was granted by the 3rd Criminal Court of Mogi das Cruzes on April 28 of this year. In the decision, the Court determined that Mario Luiz Moreno Junior maintains a minimum distance of 200 meters from the councilor, does not maintain contact with her and does not frequent the same places. It was also determined to initiate a police investigation to investigate the facts narrated by the parliamentarian. When granting the measures, the judge understood that there were sufficient elements, in an initial analysis of the case, to justify the protection, citing a risk to the councilor's integrity and reports of persecution, intimidation and attempted interference in her personal and professional activities. What Mario Luiz Moreno Junior says In a note sent to g1, Mario Luiz Moreno Junior denied the accusations made by the councilor. He stated that the protective measure was granted in precautionary analysis, said he trusts that the facts will be clarified by the Court and reiterated the version that Malu went to his residence without authorization. Finally, he stated that, if it is proven that there was a false imputation of a crime to provoke an investigation against an innocent person, the legislation provides for liability, including for the crime of slanderous denunciation.
