Expired vaccine The woman was one of the professionals who received the second dose of the Oxford/AstraZeneca vaccine after the expiration date in April 2021. The city hall and the institution responsible for the health unit admitted the mistake and administered a booster dose. At the time, employees received the immunization on April 21, one week after batch 4120Z005 expired. In court, the defense of the institute responsible for the hospital stated that there was a national problem, but that Anvisa extended the validity of the batch and, even so, there was revaccination and the offer of medical and psychological support. However, the worker declared to the Court that the situation caused anguish and insecurity, mainly because she continued working on the front line of the fight against the pandemic without proper immunization for almost three months. Judge Joyce Sant’Anna Simões understood that, although there was no proof of physical damage, the situation violated the woman’s personality rights. Other complaints The court also condemned the hospital for moral harassment. This is because the professional reported verbal humiliation, humiliating reprimands, hostile treatment, abusive control of bathroom visits and racial and sexual offenses by the manager, who was dismissed from the company after an internal investigation. For the judge, the evidence demonstrated repeated abusive conduct and a violation of the worker's dignity. There was also compensation for moral damages due to the discriminatory and retaliatory dismissal. The employee claimed that she was dismissed without cause in May 2024, one day after giving testimony as a witness in a labor action filed by a former colleague against the same hospital. Although the institute claimed to the Court that the dismissal was justified by an administrative restructuring of the financial sector, the judge understood that time and the sequence of events allowed the conclusion that the dismissal was a reprisal for the author's role as a witness, with a potential intimidating effect on other employees. Requests rejected Despite the sentence, the 4th Labor Court of Santos denied other requests made by the worker, which totaled compensation of R$ 1,556,600.70, such as: Deviation of function; Overtime, time bank and intra-workday breaks; Additional hazard pay; Occupational illness. The former employee's lawyer, Alexandre Correia, stated that he received the decision “in a partially satisfactory manner”, because, according to him, the sentence recognized serious facts narrated by the client and condemned the hospital for three different conducts.
