Servers face difficulties in Saúde Servidor in Juiz de Fora Two laws sanctioned this Tuesday (21) promote changes in the management of the health plan for public servants in Juiz de Fora. The measures restructure the old Health Assistance Program (PAS-JF), create a new administrative structure to serve beneficiaries and establish mechanisms to settle debts with hospitals, clinics and other service providers. ? Law No. 15,449 establishes the PAS-JF Special Regularization Fund, with the aim of organizing the payment of debts accumulated under the old program, which reach around R$24 million. New program and creation of an authority One of the main changes is the creation of the Public Health Program Management Authority (AGPSS), responsible for managing and supervising the new health program. The entity will have its own legal personality and administrative, financial and patrimonial autonomy. The structure will have an Executive Board, Board of Directors and Fiscal Council, in addition to its own staff. With the change, the municipality no longer directly manages the health plan. The services will be provided by an operator contracted through a bidding process. AGPSS is also responsible for monitoring the execution of the contract, supervising the adjustments applied by the company and defending the interests of employees benefiting from the program. Health aid and co-participation rules The new legislation creates Health Aid, which will be used to subsidize the payment of the plan contracted through a bidding process. Under the new model, employees who join the program will pay a monthly fee directly to the contracted operator. The city hall will grant assistance to help cover this amount. The co-participation rules were also defined: The server may be charged up to 30% per procedure; Billing will be limited to outpatient care; Hospitalizations, surgeries, oncology treatments and other hospital procedures will not have co-participation. The contract must also guarantee the minimum coverage required by the National Supplementary Health Agency (ANS). In a note, the city hall informed that the value of the health aid is still under discussion at the Trade Union Forum, together with the Working Group responsible for the benefit. The monthly fees will depend on the bidding process, and the notice for hiring the operator published after the creation of the authority. Debts of the former PAS-JF The new authority will not be responsible for the debts accumulated by the former PAS-JF. The debts will continue to be the responsibility of the Municipality of Juiz de Fora. Law No. 15,449 creates a specific fund to organize this payment and allows the city hall to make compensations between amounts it has to receive and debts owed to providers, as long as there is authorization from those involved. The measure also provides priority for smaller debts and the possibility of agreements to resolve pending issues. According to information related to the program, the debt with suppliers and service providers is approximately R$24 million. Other rules envisaged are: Adhesion to the program remains voluntary; The transition period will be six months, with the possibility of extension for another six months; Health care must be maintained during the implementation of the new structure. Participation and transparency Management of the new program will include the participation of representatives of civil servants and trade unions on the Board of Directors. The legislation also determines the periodic disclosure of management information, financial data and performance indicators on an electronic portal. Financial balance To maintain the sustainability of the program, the law establishes mechanisms such as: Creation of the Technical Reserve Fund, intended to cover cost fluctuations; Rules for sharing adjustments when there is a need for financial recovery; Technical limit for annual adjustments provided for in the plan contract notice. With the changes, the municipality seeks to replace the previous PAS-JF model with a new management structure, with the hiring of a health operator, financial assistance to employees and mechanisms to settle pending issues accumulated by the program.
