"Based on a municipal law that for me is unconstitutional, they arrive, don't notify anyone, they see that there is an irregular construction in that place, ready, with people living, they arrive, remove the people, order them to leave, with the police force, and carry out the demolition. But the law does not authorize this", highlights Cláudio Martins, lawyer who represents the families. The lawyer said he intends to determine the responsibility of the public authorities and seek compensation for the demolitions. During the interview, the Secretary of Urban Security of Itaquaquecetuba, Anderson Caldeira, stated that the action is part of the fight against illegal subdivisions and that the constructions are in a Permanent Preservation Area (APP) and in a location at risk of landslides. Regarding the residents' claim that there was no notification, the secretary stated that the residents were notified. "The inspection sector of the Department of Revenue has already had administrative processes going on for months, everyone was duly notified [...] In this case, it is not about expropriation, it is about administrative application of municipal law", informed Anderson. During the interview, residents objected when they heard the secretary say that the notifications had been delivered. According to Caldeira, another house would be demolished this Monday. He states that the City Hall operates through an administrative process and has a period of 30 days to inform the Public Ministry of the measures taken. According to him, the Housing Department has already advised residents on how to occupy the area. TV Diário asked City Hall where the residents will be taken, in a note they informed that "at the moment, there is no collective removal operation for families, which is why there is no definition of housing referral resulting from this specific action". The note also says that "the municipal administration will continue to adopt the necessary measures to prevent new irregular occupations, protect environmentally sensitive areas and comply with the determinations of control bodies, preserving due legal process and the rights of the population."
