Magnific motorcycle accident A driver was ordered to pay R$20,000 for moral damages to a motorcyclist who had the big toe of his right foot amputated after a traffic accident that occurred in Currais Novos, in the Seridó region of Rio Grande do Norte. The decision is made by the 1st Court of the District of Currais Novos. According to the lawsuit, the accident happened on the night of May 14, 2024. The motorcyclist was traveling along Rua Cândido Dantas de Araújo when the driver entered the road without respecting the mandatory stop and without signaling the maneuver, causing the collision. ? According to the records, the driver admitted in the Police Report that he noticed the motorcycle approaching, but still carried out the maneuver. The motorcyclist stated that he was traveling within the speed limit, as there was a speed bump on the stretch, and that he had the right of way on the road. When analyzing the case, judge André Pessoa concluded that the guilt for the accident was proven by the parties' reports and the police report. In the sentence, the magistrate highlighted that the motorcyclist drove the vehicle with the expected caution, while the driver acted recklessly by entering the avenue without making sure that the maneuver could be carried out safely. The judge also rejected the argument that the victim did not have a National Driving License (CNH). According to the decision, the lack of qualification, in itself, does not eliminate responsibility for the accident nor the duty to compensate, as understood by the Superior Court of Justice (STJ), when there is no relationship between this circumstance and the incident. In addition to compensation for moral damages, the victim also requested compensation for material damages. However, this request was denied because, according to the ruling, there was not sufficient proof of the alleged losses. For the judge, toe amputation represents a serious injury, capable of causing physical and psychological damage that goes beyond everyday inconvenience, justifying the sentence to pay compensation for moral damages.
