One of the lawyers' theses was the nullity of the evidence, on the grounds that a urine test from the defendant was discarded before the counter-test. The TJ-SP, however, maintained the ruling for simple intentional homicide, with possible intent. Judge Roberto Solimene rejected the defense's thesis based on the expert's testimony. According to her, the urine was not kept because the test would give a different result if a retest were carried out after some time. He highlighted the version of witnesses and conversations extracted from João's cell phone, including a message in which a friend says he was bringing water to help the "alcohol go down". Solimene also pointed out that, according to witnesses, João expressed "coldness and indifference towards the fatal result". According to the police officers who responded to the incident, the defendant displayed "a bit debauched" behavior. Two witnesses revealed that João said "it was just another victim" and "it was just a life" after the accident. The defendant denied the version and said that he spoke, in a state of shock, to the witnesses: "Yes, I saw what I did. I took a life." The judges highlighted that it is up to the jury to decide whether the case will be judged as possible intent or conscious guilt. "The answer to this question depends on an in-depth examination of the evidence, a task that is the responsibility of the jurors alone," stated the decision.
