Court gives State 90 days to reduce overcrowding in Americana prison

According to the agency, the unit was designed for 639 people, but housed around 1,190 prisoners, 551 above capacity. The provisional decision was granted by the 1st Civil Court of Americana this Tuesday (28), following an action presented by prosecutor Rafael Fernandes Viana, from the city's 9th Public Prosecutor's Office. In a statement, the Public Security Secretariat (SSP) stated that the unit “operates within security and discipline standards”. The ministry also informed that two new prison units are planned, which should create 1,646 places. The secretariat did not say where these units will be located or whether the new vacancies will be allocated to the Americana region. It also did not detail what measures it will adopt to comply with the court decision.

Determinations According to the MPSP, the Court determined that the State: limit the entry of new prisoners and transfer excess inmates within 90 days; correct the problems highlighted by the Health Surveillance within the same period; regularize fire safety within 180 days; obtain the Fire Department Inspection Report, a document that proves that the building follows fire prevention and fighting rules. The decision also provides for a daily fine of R$10,000 in case of unjustified non-compliance, according to the agency. Problems encountered According to the MPSP, inspections and technical reports highlighted overcrowding, sanitary problems, irregularities in the structure and lack of authorization from the Fire Department. The agency also reported that the Court ordered the Fire Department and Health Surveillance to communicate the results of new inspections carried out at the prison. In the action, the prosecutor stated that it is "inadmissible" to keep the unit operating under these conditions. According to him, the situation disrespects “basic standards of safety, health and human dignity”. The process remains ongoing.
