In the recording released on Saturday (18), Heloísa said that, at the age of 9, she was handed over by her mother to men who sexually abused her. The report surpassed 1 million views and caused a strong response.
“Why does the mother need to be protected from a ‘civil death’, but the daughter cannot be protected from continuing to carry, for the rest of her life, the name of those who sold her to men since she was 9 years old and completely destroyed her childhood?”, he asked.

The action filed by Heloísa requested the removal of her mother and maternal grandparents from the register, in addition to the termination of her affiliation. The woman was called to participate in the process, but did not present a statement.
The request, however, was only partially accepted. In a sentence signed on December 1, 2025, the judge authorized the exclusion of the surnames “Alves Duque”, but decided to maintain maternity on the certificate.
According to the judge, there is no legal provision to eliminate a proven biological relationship from the registry. The decision mentioned the legal principle mater semper certain est, according to which the mother's identity is considered biologically certain.
When justifying the denial, the judge declared that Heloísa was not seeking adoption, but the deletion of her biological mother from the document. He also wrote that she intended to do it “like it was killing her.”
The text of the sentence also states that “the Court is not a therapeutic office” and maintains that a change in the registry would not be able to undo the past or repair the emotional damage. For the judge, the treatment of traumas should occur through “psychotherapy and/or psychoanalysis, and not in the registry offices”.
The decision itself, however, recognized that Heloísa was a victim of “abuse, neglect and cruelty”. A psychological report attached to the case also pointed out that her emotional suffering was directly associated with her mother.
The study recommended civil rupture as a form of psychic protection and indicated that the maternal surname functioned as a permanent sign of the violence suffered. This argument led the court to allow the removal of part of the name.
Before filing the lawsuit, Heloísa had already achieved another judicial change. Originally registered as Larissa, she officially used the name by which she is known today.
The defense appealed the sentence in January 2026. The case was forwarded to the São Paulo Court of Justice in June, after the end of the period given for the mother to comment.
“She never spoke out,” lawyer Andrea Galliza told g1.
In the appeal, the lawyers argue that the continuation of maternity in the register affects Heloísa's dignity, harms her mental health and goes against the protection guaranteed by the Constitution.
Another point presented by the defense is the updating of paternal affiliation. After the action began, Heloísa obtained judicial recognition of her biological father, whose existence she only discovered years later. Currently, he and the man who registered it appear on the certificate.
Andrea Galliza considers that the understanding of the first instance does not follow the changes that have occurred in Brazilian Law.
"We had a very shallow sentence. The level of justification was not reasonable for the legal reality today in Brazil, which has already seen so many changes", he declared.
