The proposal provides for the monthly payment to be deposited into the beneficiary's account. According to the text, the automated Pix can be requested at any stage of compliance with the sentence.
The project is authored by deputy Tabata Amaral (PSB-SP) and was reported in the Senate by senator Ana Paula Lobato (PSB-MA). According to the project's defense, the measure should lead to greater efficiency and security in the payment of child pensions, in addition to reducing defaults.
“This is a simple, objective solution and compatible with the urgent nature of the maintenance obligation”, wrote the senator in her opinion. According to the parliamentarian, the measure should reduce disputes and facilitate the regularity of installments.
Early settlements
According to the project, when the judge determines the payment of alimony, the necessary data for the deposit will be informed, including the monthly amount of the installment, the duration, the accounts for debit and credit, in addition to the criteria for updating the values.
As the procedure will be automated, the author of the project argued that the measure should guarantee improved control and transparency of financial transactions.
Less litigation
Current rules provide that alimony can be debited from the debtor's salary. However, if the person does not have a formal employment relationship, the beneficiary needs to take legal action when payment does not occur.
According to the approved project, if there is not enough balance in the account of the person paying the pension, the person may have accounts blocked up to the limit of the amount of the outstanding payment. If this person is an individual entrepreneur, the assets may become unavailable and be converted into a seizure if the default continues.
