Woman obtains decision from TJ to remove gambling-addicted husband from home

The woman reported in the process that her husband developed an addiction to online gambling games, such as Bets and Tigrinho. The couple had been together since 2021, when they married under the partial community property regime and have not had children since then, according to a decision obtained by UOL.

The defendant would have used his partner's joint and individual assets over time. The woman reports that he handed over her vehicle to pay off debts made to loan sharks, in addition to committing fraud at work - which required compensation.

The victim also said that she started to bear household expenses alone. She says that, in parallel, she paid bills related to the construction of the couple's property, which was built on land obtained in her partner's name before they got married.

The judge decided, last Thursday, that the man's stay in the residence represented a danger. "Keeping the defendant in the marital home, given the tension and financial and social risk mentioned (involvement with loan sharking), represents a danger to the physical and psychological integrity of the author", wrote magistrate Daniel Maciel Martins Fernandes.

Fernandes also determined the unavailability of the couple's property. The measure prevents the sale, donation or encumbrance of it, which could eventually be used by the man against the woman's will.

Her lawyers also asked for his financial blockade, which was denied by the TJ. The judge said, however, that the request could be reanalyzed at another point in the action, if "exceptional circumstances are demonstrated that justify the adoption of the measure."

The Court also scheduled a Conciliation hearing. After that, the defendant will have 15 days to file a response regarding the case.
