The minister's statements are contained in a note released to the press after the announcement of the new United States tariff on Brazilian products. Among the justifications for adopting the measure, the North American government cited STF decisions on big techs, such as the one that determines that platforms need to take illegal content off the air without needing a court order.
Fachin said that the Supreme Court exercises its functions based on the Brazilian Constitution and that the court's decisions are public and based on the law.
"The Federal Supreme Court will continue to exercise, with serenity, independence and firmness, the mission entrusted to it by the Constitution of the Republic, without any influence, pressure or conditioning of an external nature, preserving the integrity of the constitutional order, the separation of Powers, democracy and the Rule of Law", he stated.
The president of the STF also defended the independence of the Brazilian Judiciary.
"Disagreements between States must be conducted through diplomatic channels and the mechanisms specific to International Law, never through initiatives that could be interpreted as a form of constraint on the exercise of constitutional jurisdiction", he added.
Decisions
In recent decisions, Minister Alexandre de Moraes ordered the suspension of profiles of Brazilians living in the United States. The targets are accused of anti-democratic attacks against the Supreme Court. Due to the decision, Moraes was sued in Florida courts by the social networks Rumble and Trump Media.
The minister's defense is carried out abroad by the Attorney General's Office (AGU). The body defends Brazilian sovereignty and maintains that public agents cannot be directly targeted by the Judiciary of other countries without the consent of the Brazilian State.
