The order was directed to the courts of the Federal District, Goiás, Maranhão, Paraná, Rio de Janeiro, Rio Grande do Norte and Rondônia. According to a report published by Folha de S.Paulo, these units violated the STF decision that limited payments of remuneration and compensation funds to a maximum of 70% of the public service ceiling, which would be equivalent to approximately R$78 thousand.
The dispatches from Dino and Moraes were identical when requesting the information, but with the difference that the prime minister was more incisive in mentioning the possibility of dismissing the presidents of the TJs who had violated the rules defined by the Supreme Court. Moraes mentioned leaving his position only in the event that the required data was not provided.
"The occurrence of any type of non-compliance with the STF's determinations, regarding the established limits, may result in removal from office and promotion of criminal, civil and disciplinary liability", wrote Dino.
These Courts, however, reportedly paid amounts in excess of R$400,000 to some judges in May. Moraes demands that the heads of the TJs detail the amounts and funds paid to each active and retired magistrate, as well as to pensioners, in the months of April, May, June and July of this year. The information must be provided individually and with proof of payments made.
As Estadão revealed, in another move to circumvent the STF's decision that limited payments for penduricalhos, the national inspector of Justice, Mauro Campbell, authorized courts across the country to pay retroactive amounts of the Additional for Time of Service (ATS). It turns out, however, that the decision was given even before the Supreme Court had finished judging this issue and at a time when this type of measure was prohibited.
