SÃO PAULO, SP (FOLHAPRESS) - The court ordered the preventive detention (without a deadline) of lawyer Jeferson Nascimento Barros, 35, who was being investigated for running over a man twice and allegedly fleeing without providing help, in the south zone of São Paulo.

He is suspected of attempted murder and drunk driving. His defense claims that the collision was not voluntary and that Jeferson left the scene in fear of being attacked.

The Civil Police searched addresses linked to him this Monday (20), but the lawyer was not located and is considered a fugitive.

The vehicle he was driving, an HB20, was found in a parking lot and had several damages.

Eder Vulczak, the delegate responsible for the case, said that Jeferson was drunk.

"Through the testimonial evidence, we found that he had a staggering gait, disjointed speech, and witnesses reported that he was completely altered at the time of the accident. In fact, his friend who was with him in the vehicle mentioned that they were in a bar, in Campo Limpo, drinking alcohol," he stated.

The collision occurred in the early hours of Saturday (18), on the Itapecerica road, in the Parque Fernanda neighborhood. Jeferson made a turn to access the opposite direction of the road and hit a motorcycle driven by Cid Baldacci Correia, 66.

Jeferson, who was with two friends in the vehicle, stopped, but, according to the SSP (Secretary of Public Security), he fled the scene, running over the victim again, who was lying down and unconscious.

Cid was in serious condition and was taken to Campo Limpo Hospital, but has since been discharged.

Forensics were called and the case was registered as attempted murder and drunk driving in the 47th Police District (Capão Redondo).

Jeferson's defense, made up of six lawyers, denied, in a statement, that he had fled.

According to the defense, he did not flee after the initial collision. He would have gotten out of the vehicle and tried to calm the people around him, and his friends who were with him called for medical help, which was confirmed by telephone records.

"The second impact with the victim was not voluntary and was not an attempt to escape. The driver was surrounded by excited people who invaded the car's cabin through the window (a fact reported by an eyewitness). One of these people suddenly pulled the steering wheel of the car. As it was a vehicle with automatic transmission, this external physical interference caused an abrupt traction, causing him to completely lose control of the steering and causing the tragic and involuntary second contact", says the note.

He would have left the place out of fear of being attacked, the lawyers say.

"We received with immense relief the news that the victim has already been discharged, is well and is fully recovering at home. The victim's family will be contacted and we will be fully available to provide all the material, financial and care support necessary for her complete recovery", states the defense.
