BRASÍLIA, DF (FOLHAPRESS) - The defense of Jair Bolsonaro (PL) told the STF (Supreme Federal Court) that the former president did not know that the letter would be made public by senator Flávio Bolsonaro (PL-RJ). At the same time, I also did not know that the material violated the rules imposed by Minister Alexandre de Moraes.

"In a recent period, when subject to the same conditioning limitations, other correspondence written by him without this having given rise to any questioning regarding compliance with the measures in force at the time, even when publicized", said the lawyers.

The statement is signed by five lawyers who represent Bolsonaro in the coup plot process, in addition to Flávio Bolsonaro himself.

In the document, the defense also states that the former president did not seek out third parties to circumvent the restrictions and has remained faithful to the precautions since the beginning of the home regime.

"The fact that the letter was subsequently published on social media was a result of a decision adopted without the Petitioner's prior knowledge", they stated.

On Monday (13), Moraes banned Flávio from visiting his father for 90 days after understanding that the senator failed to comply with the precautionary measure that prohibits the former president from using social networks, directly or through third parties, by publishing a letter from Bolsonaro over the weekend.

In the letter, Bolsonaro states that Flávio is his "spokesperson" and the candidate chosen to represent him politically.

The minister said that the senator used "expressions with a semantic load equivalent to an explicit request for a vote" and classified Flávio's conduct as an "instrument of political promotion".

After the measure, Flávio Bolsonaro's pre-campaign lawyer Tracy Reinaldet stated, in a statement, that Moraes' decision is illegal and unconstitutional and that the team will take measures to reverse it, "always respecting the institutions".

The defense argued that the veto disrespects the Criminal Execution Law, the Law Firm Statute and the Federal Constitution by preventing family visits and maintaining contact with the outside world.

The senator had free access to his father due to his registration as a lawyer in the case.
