The two children were alone in the car, where the 4-year-old boy found the pistol and fired. The family had just arrived at a vacation rental property when the adults got out of the vehicle. The shooting occurred shortly before 4pm on Sunday (12), in Kissimmee, in the Orlando region.
The U.S. Attorney's Office for Florida's 9th Judicial Circuit said today it will not comment on potential charges while the investigation is ongoing. The information was released by ABC News.
The gun belonged to the victim's mother and had been left unholstered. The Osceola County Sheriff's Office said the pistol was unlocked and displayed inside the vehicle. Family members were outside when they heard the gunshot, according to WKMG, a CBS affiliate in Orlando.
The victim was identified as Brayden Tennyson, a resident of Louisville, Georgia. Emergency crews attempted to revive him before taking him to Arnold Palmer Children's Hospital, where he died. Brayden would have turned 3 on Tuesday (14), and the trip to Florida had been organized to celebrate his birthday and visit the Disney parks, according to WRDW/WAGT.
Investigators from the homicide division met with representatives from the Prosecutor's Office to discuss possible accountability. Sheriff Chris Blackmon said charges are likely, but as of this morning, according to ABC News, no one had been charged.
Blackmon said a simple lock could have prevented the child's death. During a press conference, the sheriff said the gun was "literally in plain view" and showed a device used to prevent the trigger from being pulled. "It's not a video game. You can't press a button and start over," he said. The sheriff's office distributes free gun locks to county residents, Fox 35 Orlando has learned.
The Florida Department of Children and Families and the medical examiner's office were called. Police also intend to speak to the 4-year-old boy during the investigation.
