In the first instance, the Court ordered reimbursement of the value of the vehicle and compensation for the period without work. Defense arguments The workshop appealed. He maintained that the theft was an external accident, caused by third parties and beyond the company's control. He also stated that there was no evidence of the financial loss alleged by the client. The truck owner argued that the workshop assumed the duty of guarding and monitoring upon receiving the vehicle. She considered crime as an inherent risk to the activity. According to the judge, companies that receive goods from third parties must foresee and mitigate property crimes. She stated that the violence of the robbery did not remove the workshop's responsibility. The decision highlighted that responsibility, in these cases, is objective. The values ??were not informed, as they will be defined during the settlement phase. Judges Francisco Costa and José Américo Martins da Costa followed the vote. On the other hand, the collegiate denied compensation for moral damages, as there was no proof of harm to honor or personality rights.
