In defense, according to the Judiciary, the municipality and the Fundação Social Hospitalar de Içara stated that the care provided was adequate and that the complications resulted exclusively from the accident. The judicial expert, however, concluded that the injury was not examined properly to locate the wooden fragment. The report also pointed out that the presence of the foreign body contributed to the development of the infection and the need for surgery. The municipality and the hospital were jointly ordered to pay R$8,000 for moral damages and R$712.09 for material damages, amounts that will be subject to interest and monetary correction.
