In the decision, the judge highlighted that the Federal Constitution prohibits the work of minors under the age of 16, with the exception of cases of professional learning from the age of 14 and judicially authorized artistic activities. During the analysis of the case, the court identified that some of the content produced by the teenager contained elements considered inappropriate for the age group, with indirect references to sexualization, adultization and the romanticization of relationships between teenagers.

Recording routine The decision also took into account the content production routine. As reported by the teenager's mother, recordings took place on Friday afternoons and throughout Saturday. For the judge, the production load could compromise the teenager's fundamental rights, such as leisure, rest and an experience of adolescence without the pressure of performance on social networks. “It must be emphasized that the recording routine imposed on the teenager is exhausting and directly compromises her fundamental right to leisure, unsupervised rest and the experience of an adolescence free from algorithmic pressure and work performance”, stated the judge. Another point considered in the decision was the fact that the income obtained by the teenager exceeded the income of the family nucleus. According to the judge, the situation could characterize undue economic exploitation. The decision also cited Resolution No. 687/2026 of the National Council of Justice (CNJ), which establishes restrictions on the use of images of children and adolescents when there is a risk of economic exploitation, violation of rights or encouragement of behaviors harmful to development. Prohibition and monitoring With the decision, parents were prohibited from using the teenager's image as a digital influencer or content creator on social networks. In case of non-compliance, a daily fine of R$1,000 will be imposed, in addition to the possibility of administrative and criminal liability. The judge also ordered the sending of a copy of the process to the Public Ministry of Labor (MPT), which will continue to monitor the case. The Guardianship Council responsible for the region where the family lives must carry out periodic monitoring. Furthermore, the adolescent must receive ongoing psychological support through the public health network, with the aim of reducing possible impacts caused by exposure on social networks.
