Family members should not withdraw INSS benefits after the death of the insured person; see what to do
GABRIELA CECCHINSÃO PAULO, SP (FOLHAPRESS) - The mother of retiree Laércio Marcondes, 63, died at the age of 98, on May 29 of this year. The son was surprised when, on June 8, the retiree's bank account received the...
Without finding clear guidance on the internet and after receiving conflicting information over the phone, Laércio withdrew the amount he considered proportional to his lifetime to deal with the inventory and funeral procedures, but decided to leave part of the money in the account.
"I was especially intrigued by what happens to amounts belonging to the INSS that are deposited months in advance and the beneficiary dies," he says.
The situation is more common than it seems and raises doubts among family members about whether the money can be used for funeral expenses, whether it should remain in the account or whether it will need to be returned.
According to the INSS, the guideline is not to move amounts deposited after the beneficiary's death, as the payment becomes considered undue. If there is any amount actually owed up to the date of death - the so-called "benefit residue" -, it may be requested later by dependents entitled to the death pension or by heirs recognized by court.
The request must be made through the service "Request amount not received by the date of the beneficiary's death", available on the institute's service channels. Another question concerns the insured's debts. According to the INSS, with the death of the beneficiary, the discount on the installments of the loan will no longer be made, as the benefit ends.
The body also states that these discounts are not transferred to a possible death pension, if it is granted to dependents.
WHAT TO DO WITH AMOUNT DEPOSITED AFTER THE BENEFICIARY’S DEATH?
The INSS says that family members should not move amounts deposited after the death of the insured, as any payment made after the date of death is considered undue by the institute.
WHAT IS THE BENEFIT RESIDUE?The benefit residue is the money actually owed to the insured until the date of his death, that is, the value proportional to the insured's lifetime in the month in which he died.
WHO CAN REQUEST THE MONEY?According to the INSS, dependents entitled to the death pension or judicially recognized heirs can request the amounts.

WHAT HAPPENS TO THE CONSIGNATED LOAN INSTALLMENTS? With the death of the beneficiary, the benefit ends and the discounts on the assigned loan installments are no longer made. Furthermore, these debts are not transferred to any death pension granted to dependents.
WHY CAN A BENEFIT BE DEPOSITED AFTER THE DEATH OF THE INSURED?According to the institute, this happens because there is a gap between the communication of death and the processing of this information by the systems responsible for payments. The INSS explains that it follows a schedule to process the payroll and that, in some cases, there is a "lapse of time" between the death and the crossing of data with death records. If the payment has already been scheduled before the benefit ends, the amount can be credited to the account.
HOW TO REPORT DEATH TO THE INSS?Although notary offices report deaths to public bodies, family members can also report the death to the institute, via the website, app or Central 135. According to the INSS, notification by family members is optional, that is, it is not mandatory. Access My INSS via the website or app Log in with your Gov.br account Enter the field "What do you need?" benefit"Follow the system instructions to report the death
HOW DOES INSS RETAIN THE AMOUNT WITHDRAWN IMPROPERLY? According to the institute, an investigation is carried out with the banking institution to define responsibility and generate administrative charges.
