The accused threw a flammable liquid at the victim and tried to set him on fire, but the lighter he used failed at the time of the crime. The sentence, signed by judge Fábio Alexandre Costa de Farias, recognized the practice of attempted feminicide. The sentence was handed down last Wednesday (9) and can be appealed to higher courts. What is femicide? The crime occurred in 2024, with the police investigation starting on August 12th. On the 27th of the same month, the Court accepted the Public Prosecutor's complaint. According to the decision, the crime occurred in the context of domestic and gender-based violence. The case states that, due to the constant physical attacks carried out by the defendant, the victim fled the municipality of Bujari, in the interior of Acre. After escaping, the accused found her and went to the place where she was taking refuge with a can of thinner (flammable liquid) and a lighter. He then tried to start the fire by trying to light the lighter. However, the fire did not start because the mechanism failed. “The prior deliberation and preparation of the means used show coldness and premeditation, elements that are not part of the type or qualifications recognized in plenary by the sentencing council, which denotes more intense intent and greater censorship [...]”, says part of the sentence. According to the document, the accused did not accept the end of the relationship. In addition to the testimonies of the victim and witnesses, the process also brings together a psychiatric report on Frank, which concluded that he was capable of understanding the illicit nature of his conduct and of being responsible for his actions. "The official expert stated that the accused was, at the time of the action, fully capable of understanding the illicit nature of the fact and of determining himself in accordance with this understanding, highlighting, however, the maximum dangerousness of the agent and the high risk of recurrence. These are concrete and suitable technical elements, subject to contradiction, which authorize the negative assessment of personality", details the document. Furthermore, he threatened to burn down the entire property and kill both his ex-partner and a friend who was with her at the time of the attack. The attempt only ended when he left the place promising to return to complete the crime. “[...] Such circumstances reveal a degree of boldness, criminal persistence and harmful potential significantly higher than those normally inherent to the crime, justifying the unfavorable assessment of the judicial circumstance provided for in article 59 of the Penal Code”, points out the text. When determining the accused's sentence, the Court also considered that the victim remains traumatized and is undergoing psychosocial care, in addition to avoiding leaving home due to the crime.
