"In theory, the case would receive this framework today. However, it cannot be retroactive, which is why the accused was tried and convicted of qualified homicide for futile reasons", he highlighted. In the sentence, judge Rafael de Lima Sampaio Rosa highlighted that the circumstances of the crime caused the disruption of the family nucleus and left the four children permanently deprived of their mother's coexistence. After the crime, the accused fled and remained hidden for more than ten years. He was only located and arrested in 2024, a circumstance that contributed to the delay in completing the process. The convicted person must serve his sentence in an initial closed regime.
