The decision was taken this Wednesday (16), when the São Paulo Court of Justice received the complaint presented by the Public Ministry. Felipe Augusto is accused of diverting 2,187 ammunition from the Municipal Civil Guard. According to the prosecution, the material belonged to the City of São Sebastião and was seized at his home, in Praia do Porto Grande. In the process, the former mayor's defense claims that there was no criminal intent and asked for the complaint to be rejected, but the judges understood that there was sufficient evidence to proceed with the action. Instruction phase and other questions With the receipt of the complaint, the process regarding the alleged diversion of ammunition now enters the investigation phase. At this stage, evidence will be produced and witnesses will be heard before the merits are judged. The case adds to other questions involving the former mayor's management. In June of this year, the São Sebastião Chamber rejected the City Hall's accounts for 2022, the last full year of Felipe Augusto's administration, following an unfavorable opinion from the São Paulo State Court of Auditors (TCE-SP). What does the defense say? Lawyer Anthero Mendes, who represents the former mayor, told Rede Vanguarda that Felipe Augusto was not aware of the existence of ammunition in the property. "He is completely unaware, especially because at the time the operation took place, he had been abroad for a long time. Therefore, he is unaware and unaware of what really happened. There is a situation that needs to be investigated: how this ammunition ended up there," he said. The lawyer also stated that the defense is confident that the action will be dismissed.
