The company owner may be held liable for the crime provided for in the Penal Code, with a penalty ranging from one to four years in prison, in addition to a fine. He was not arrested. Also according to EDP, in addition to the criminal sanctions, the person responsible for the fraud must reimburse the amounts relating to the energy consumed and not billed during the period of the irregularity, in addition to paying the administrative costs provided for in the rules of the National Electric Energy Agency (Aneel). Impact of fraud In 2025 alone, EDP reported having recovered 25.7 GWh of diverted energy in Alto Tietê — enough volume to supply a city with around 75 thousand inhabitants for a month. According to the distributor, energy theft does not only cause financial losses. Clandestine connections can cause overload on the electrical grid, interruptions in supply, risk of shocks and accidents, in addition to affecting consumers in the region.
