Click here to follow the g1 PB channel on WhatsApp The Federal Regional Court of the 5th Region (TRF-5) upheld the conviction of the former manager for six crimes of misappropriation of public income, committed in criminal continuity between the years 2006 and 2007. The initial sentence had been handed down by the Federal Court. According to the court decision, José Edivan Félix used false invoices, receipts considered unsuitable and checks to divert resources from federal programs, such as the Child Labor Eradication Program (Peti), the Comprehensive Family Care Program (Paif) and funds allocated to school meals. With the judgment, the case has become final and there is no longer any possibility of appeal. The established sentence is 6 years and 9 months in prison, in an initial semi-open regime. In addition to prison, the decision determines the loss of any public position held by the former mayor, the prohibition of exercising public functions for a period of five years, the reimbursement of amounts caused to public coffers and the payment of procedural costs.

The deviations According to the process, the deviations were identified after an inspection by the General Comptroller of the Union (CGU). According to the Court, the scheme worked by issuing checks payable to the municipal treasury, which were withdrawn in cash. When rendering accounts, false documents were presented with the aim of simulating payments to suppliers. The decision recognized six episodes of embezzlement of public resources, which totaled R$ 17,900 in values ??at the time, referring to the year 2007. According to the process, José Edivan Félix participated directly in the scheme by signing commitment notes and checks used in withdrawals, authorizing the movement of federal resources and presenting false documents to hide the embezzlement during accountability. With the conviction becoming final, the Court also determined that the full reimbursement of the amounts to the public coffers will be one of the conditions for a possible progression to the prison regime.
