Court condemns councilors for fraud in Bom Jesus Five political agents from Bom Jesus do Itabapoana, in the Northwest of Rio de Janeiro, were convicted by the Rio de Janeiro Court for the crimes of ideological falsehood and use of a false document. The decision was handed down by the 2nd District Court of Bom Jesus do Itabapoana and is related to an administrative process that resulted in the removal of the then president of the City Council, Luciara Amil Nunes Azevedo, in 2022. Those convicted are the current councilors José Luiz Rezende do Carmo, Samuel Júnior Soares de Aguiar and Sérgio Ney Borges Crizóstomo, in addition to former councilors Cleber Reis do Nascimento and Eduardo Alves Paiva. According to the sentence, the defendants inserted false information in the final report of Administrative Process No. 50/2022, a document used to justify Luciara's dismissal from the presidency of the Chamber and her removal from office for 30 days. ? According to the decision, the evidence produced during the procedural investigation did not confirm the information presented in the report. The judge also highlighted that technical witnesses ruled out the existence of the alleged loss to public coffers that was the basis for the administrative process. The ruling also mentions that the Court of Auditors of the State of Rio de Janeiro (TCE-RJ) approved the City Council's accounts for the 2021 financial year, without pointing out any irregularities. Each of the convicts received a sentence of 2 years, 8 months and 15 days in prison, initially under an open regime. However, because they were first-time offenders and the crimes were not committed with violence or serious threat, the custodial sentence was replaced by two rights-restricting measures: the payment of R$2,000 and weekend restrictions, with stay at home for five hours on Saturdays and Sundays. The court also set a minimum compensation of R$10,000 for moral damages in favor of Luciara Amil Nunes Azevedo. The amount must be paid jointly by the convicts. The defendants were acquitted of charges of political gender violence, abuse of authority and one of the charges related to the use of a false document. Elma Soares Cardoso Abreu de Oliveira, who was also responding to the case, was acquitted of the accusation of ideological falsehood. The decision is of first instance and can still be appealed.
