During the process, Energisa stated that there was no relationship between the energy fluctuation and the equipment defect. The company also claimed that the technical report presented by the State was made unilaterally and raised the possibility that the problem was caused by faults in the building's internal electrical installation. The company's justifications, however, were rejected by the courts. According to the decision, the concessionaire has objective responsibility for the services provided, that is, it must repair the damage caused to consumers regardless of proof of fault. In addition to maintaining the conviction, the panel increased legal fees to 12% of the compensation amount. In a statement, Energisa informed that the process is still ongoing and that the decision can be appealed. The company said that it respects the Judiciary's position, but that it will appeal.
