Judge Ida Maria Costa de Andrade responded to a defense appeal and barred the summons of substitute Sassá from Construção Civil (PT), which had been determined by the judge of first instance on Friday (17). The judge understood that the immediate replacement of an elected parliamentarian, before an in-depth analysis by the Court's panel, could cause institutional instability and damage that would be difficult to repair. With the new decision, Jaildo remains in office until the final judgment of the appeal. On Friday (17), judge Aldrin Henrique de Castro Rodrigues, from the 4th Public Finance Court, had ordered Jaildo's loss of mandate and the suspension of his payments. The decision responded to a request from the Municipal Directorate of the Workers' Party (PT), which claimed that Jaildo Oliveira was definitively sentenced to reimburse public coffers for irregularities in the use of the Quota for the Exercise of Parliamentary Activity (CEAP). ? Jaildo Oliveira's defense appealed the decision. The main arguments were: Lack of political punishment: The lawyers claim that the original conviction only provided for the reimbursement of R$101,500 to the treasury, without including the loss of office or the suspension of political rights. Judge's incompetence: The defense argued that a judge of first instance does not have legal power to judge acts of the Mayor of the City Council; According to the State Constitution, this jurisdiction would be exclusive to the Court of Justice. Deadline expired: The parliamentarian argued that the PT missed the legal deadline to file the writ of mandamus, as the process that motivated the action ended in April 2025. When analyzing the case, judge Ida Maria considered that there are indications that the first instance judge did not have the competence to judge the action. She highlighted that the Internal Regulations of the Court of Justice of Amazonas establish that it is up to the Reunited Chambers to judge actions against acts of the presidency of municipal chambers. After the end of the judicial shift, the case will be forwarded to the Meeting Chambers of the Court of Justice of Amazonas, where the merits of the appeal will be definitively analyzed by a group of judges.
