The judge highlighted in the decision that the company has a series of policies to combat discrimination and promote diversity. Furthermore, Vianna pointed out that contracts signed with outsourced security companies include a clause protecting dignity and human rights, obliging the contractor to adopt practices to combat racism, homophobia and any forms of discrimination. "This vast body of evidence reveals that the defendant, long before the episodes narrated, had already implemented policies, training and reporting channels designed to curb any form of racial discrimination, in absolute accordance with the constitutional principles of human dignity and equality", he says. The case was at the Assaí wholesale chain, which is located in the city center. The wholesale chain informed, after the episode, that as an immediate decision, an internal investigation process was opened, the employee responsible for the approach was removed and, days later, his dismissal was formalized. The chain also said that it does not adopt or advise embarrassing approaches to customers. The man's wife, who was 56 years old at the time, told EPTV, a TV Globo affiliate, that her husband had gone to the supermarket to research prices and ended up choosing not to buy anything. On his way out, he was approached by employees there, who allegedly made him take off his sweater and pants to prove that he had not taken products without paying. After the incident, the man became nervous, started crying and had to be calmed down by his own employees in a corner of the store, where several people criticized the security guards' attitude.
