The Federal Police (PF) executed a search and seizure warrant at the residence of former president Jair Bolsonaro (PL), where he is under house arrest, in Brasília, this Wednesday, 8th. The measure was determined by Minister Alexandre de Moraes, of the Federal Supreme Court (STF).
The agents were looking for weapons, ammunition, accessories and registration documents that might be at the scene. João Henrique de Freitas, one of Bolsonaro's lawyers, said that nothing was found and classified the action as "regrettable".
"The defense had previously reported the whereabouts of all the weapons. Result: nothing was found. It is regrettable that a former President of the Republic is still subjected to this type of action," he stated.
The searches take place after the Army handed over six of the former president's eight weapons, after one was seized in a raid in the Federal District in June. In an official statement, the corporation stated that two were not in its custody: a nine-millimeter Glock pistol and a 12-gauge shotgun from the manufacturer Maestro Arms Company.
According to Bolsonaro's defense, the pistol is the same one seized during a raid in the possession of a soldier who works in Bolsonaro's security and is protected by the Civil Police of the Federal District. The shotgun, the lawyers claim, was given to Bolsonaro as a gift, but was never removed and remains in the custody of a company that imports war items in Caxias do Sul (RS).
In his decision authorizing the search and seizure of Bolsonaro's residence, Moraes argued that there is a discrepancy between the number of firearms regularly registered in Bolsonaro's name and those actually delivered to the competent bodies, failing to comply with the court order.
The minister also pointed out that, although the defense maintains that one of the weapons was never removed, this "evidences inconsistency in the information provided by the convicted person". "This is because the version presented differs from the data contained in existing records and was not accompanied by suitable documentation capable of proving the actual location of the weapons, the identity of the supposed depositary or the regularity of the alleged custody", he highlighted.
"In the present hypothesis, the discrepancy between the information contained in the case file and that subsequently presented by the Defense makes it essential to adopt a home search and seizure in order to ensure effective compliance with the court order for the full surrender of firearms and eliminate any doubts regarding the continued possession of weapons, directly or indirectly, by the convicted Jair Messias Bolsonaro," Moraes added in the decision.
