SÃO PAULO, SP (FOLHAPRESS) - The Limeira Public Prosecutor's Office reported to the Court, this Tuesday (7), four people accused of involvement in the death of student Maria Eduarda Rodrigues de Freitas, 21. She was thrown without ropes from the Esqueleto bridge, in the interior city of São Paulo, on June 13, in a practice known as rope jumping.

Instructors Luis Felipe Feliciano Egoroff, 32, Maicon Fernandes Cintra, 42, and Vitor de Freitas Gonçalves, 27, must respond, if the Court accepts the complaint, for murder with possible intent, qualified by a base motive and a resource that made the victim's defense impossible.

The Public Prosecutor's Office argues that those responsible for the jump knew the risks of the activity, but did not take the necessary precautions, such as checking the safety rope connection and double checking the equipment.

The complaint also states that the group did not have a clear definition of functions, commercialized the activity without meeting applicable legal requirements and prioritized economic interests and publicizing the jumps on social networks to the detriment of the participants' safety.

The defense of Luis Felipe and Maicon stated that they disagreed with the Public Ministry.

"The accused Maicon and Luis Felipe did not intend to take the victim's life, nor did they assume the risk of their conduct, acting culpably [without intention]. The defense also disagrees with the qualifiers contained in the complaint", stated, in a note, Rafael Gomes dos Santos, Gabriela Cristina Camara and Daniel Ricardo Batista.

Vitor's defense said that they should issue a note after analyzing the document. Evelyne dos Santos Gonçalves was also charged with the murder, in addition to being accused of improper omission and procedural fraud.

The Public Prosecutor's Office maintains that it had a duty to guarantee the safety of participants and interrupt the activity in the face of inadequate conditions, but it failed to do so even after allegedly learning of a similar operational failure that had occurred previously.

In the case of procedural fraud, the Public Prosecutor's Office understands that she tried to eliminate evidence relevant to the investigation.

According to the indictment, she ordered the recovery of the GoPro camera used by the victim and the deletion of its contents to make it difficult to clarify the case.

The report did not identify who represents Evelyne in court.

The Prosecutor's Office requested that the three instructors' preventive detention be maintained. In relation to the woman, he requested the conversion of temporary detention into preventive detention (without a deadline).

In addition to sentencing the accused, prosecutors asked them to pay compensation of R$200,000.

"The technical non-compliance was added to the formal irregularity of the activity itself. The defendants commercially exploited rope jumping without registering in the Cadastur (Register of Tourist Service Providers) of the Ministry of Tourism, without taking out civil liability insurance and without preparing terms of knowledge, responsibility and risk awareness to be signed by the participants, requirements already in force at the time of the events", the prosecutors point out.

The Court must now analyze and decide whether to receive the complaint, initiating criminal action.
