Marielle case: Dino maintains loss of Chiquinho Brazão's mandate

Minister Flávio Dino, of the Federal Supreme Court (STF), decided this Tuesday (21), to maintain the revocation of the mandate of former deputy Chiquinho Brazão (No party-RJ), one of those convicted of acting as mastermind in the murder of councilor Marielle Franco and driver Anderson Gomes, in 2018.

In April last year, the Chamber of Deputies declared Chiquinho's loss of office due to absences, as determined by the Constitution. He stopped attending the sessions because he is in prison.

In the writ of mandamus filed with the Supreme Court, the former deputy's defense said that the House did not respect the right to the presumption of innocence and declared the loss of mandate automatically after accounting for a third of absences.

In Flávio Dino's understanding, the House's decision followed the Constitution and internal regulations.

"The judgment on the merits of Criminal Action No. 2,434 (Marielle Case), with the sentence of the petitioner to a sentence of 76 years and three months' imprisonment, in an initial closed regime, and the maintenance of his preventive detention, confirms the material and legal impossibility of exercising the parliamentary mandate", stated the minister.

Conviction

In February of this year, the First Panel of the Supreme Court convicted the counselor of the Rio de Janeiro Court of Auditors (TCE-RJ) Domingos Brazão, the former federal deputy Chiquinho Brazão, the former head of the Civil Police of Rio de Janeiro Rivaldo Barbosa, the Major of the Military Police Ronald de Paula and the former military police officer Robson Calixto for participating in the murder of Marielle and her driver.

Brothers Domingos and Chiquinho Brazão were sentenced to 76 years in prison.

Rivaldo received an 18-year prison sentence. Ronald will serve 56 years in prison, and Robson Calixto was sentenced to 9 years. Everyone is arrested and is serving a permanent sentence, except for Chiquinho, who is under house arrest for health reasons.
