The 2nd Criminal Court of the Court of Justice of Rio de Janeiro denied a request from the defense of former councilor Jairo Souza Santos Júnior, known as Dr. Jairinho, to annul the decision that authorized the breaking of the confidentiality of data from his cell phone, which was seized in the prison cell where he is serving his sentence.

However, judge Elizabeth Machado Louro ordered the suspension of the effects of the decision until the habeas corpus trial presented by the defense. As a result, the judge ordered the Public Prosecutor's Office to interrupt any steps to examine the device.
"In view of the above, I reject the request for reconsideration/annulment of the decision. On the other hand, noting that the issue linked to the jurisdiction of the court is already the subject of habeas corpus filed by the defense, I consider it appropriate to grant the defense's alternative request, to suspend the effects of the decision until the trial", he wrote in the decision.
The seizure is to verify whether Jairinho tried to interfere in the progress of the process.
Conviction
In June this year, the Sentencing Council of the 2nd Jury Court of Rio sentenced Dr. Jairinho to 43 years, nine months and 20 days in prison for the death of the boy Henry Borel Medeiros, which occurred on March 8, 2021. Monique Medeiros da Costa e Silva, the child's mother, had her crime downgraded to culpable homicide (when there is no intention to kill) and received a judicial pardon.
Professor Monique Medeiros had the crime downgraded from intentional homicide (with intent to kill) to manslaughter (when there is no intent to kill) and received a judicial pardon. She was sentenced to one year and four months in prison for the crime of omission in relation to the torture suffered by her son. As Monique had already served time in pre-trial detention, her sentence was considered over.
The trial lasted 11 days and is considered the longest in the history of the Rio de Janeiro Judiciary.
