Nilson Leite Batista and Maria Goreti Saraiva were hit at around 1:20 am, on Joaquim Marra Street. The driver was arrested red-handed and charged with intentional homicide.
The report seeks to defend the suspect. During the interrogation, he chose to remain silent and has not appointed a lawyer to date.
According to the incident report registered at the 31st Police District (Vila Carrão), the driver was driving a white Chevrolet Onix at high speed when he lost control of the vehicle while making the turn leading to the viaduct. The car hit the guardrail and entered the opposite lane, running over the couple, who were walking through the area.
With the impact, Maria Goreti was thrown from the viaduct and fell from a height estimated between five and six meters, dying on the spot. Nilson was rescued in a very serious condition by Samu teams and taken to Tatuapé Municipal Hospital, but he died early in the morning.
The report states that a doctor who works at Santa Clara Hospital and was leaving her shift at the time of the accident witnessed the collision. In a statement to the police, she said she saw the vehicle hit the viaduct railing before hitting the victims. The witness provided first aid to Nilson.
When approached, the suspect had slurred speech, difficulty walking and an ethyl odor, as recorded by the police. He denied drinking alcohol and refused to take a breathalyzer test, according to police records. Referred to the Legal Medical Institute (IML), he underwent a clinical examination, the report of which confirmed that he was under the influence of alcohol.
The investigation also found that the driver's CNH (National Driving License) was expired.
The case was registered as intentional homicide because, according to the police report, the driver took the risk of causing death by driving drunk, at high speed and with an expired driver's license.
The Civil Police called in forensics to reconstruct the dynamics of the accident. The suspect will remain at the disposal of Justice and must undergo a custody hearing.
