The amount will cover 157.7 thousand policyholders who won 113.9 thousand cases against the agency.
Payment is made through RPV (Small Value Requests), which are arrears of up to 60 minimum wages -R$97,260 this year- and includes benefits such as retirement, pension, aid and BPC (Continuous Payment Benefit).
The overall total includes R$2.9 billion released by the CJF (Federal Justice Council) to the TRFs (Federal Regional Courts) to settle amounts in 194.1 thousand processes with 248.8 thousand beneficiaries.
Insured persons who won the legal action and whose payment order was given by the judge on some date in June will be entitled to the amount. The money must be deposited into the beneficiary's or his lawyer's account by the beginning of August.
In a note, the CJF informs that it is up to the TRFs to define the exact day of the deposit according to their own schedules. To find out when they will receive it, the insured must check the information on the TRF website responsible for their case or check this date with their lawyer.
The amount to be deposited can be found in the "Amount entered in the proposal" field on the TRF website responsible for the process. When the money is paid, the query status will show "Paid in full to court".
WHAT ARE INSS DELAYS?
INSS arrears are retroactive amounts paid to those who go to court and win a case against the social security body. The process may be related to review, when the insured proves that he earned a lower amount and is entitled to more, or to concession, when he seeks recognition of an initial right.
Benefits such as sickness benefit, retirement (based on contribution time, age, disability and the person with a disability) or even the BPC (Continuous Payment Benefit), which is an assistance income, can be discussed in court.
These amounts are paid in monthly installments, depending on the month in which the RPV was authorized by the judge, a stage also called assessment or issuance. It is possible to check the date of issue in the procedural monitoring, after the action becomes late.
WHO HAS THE RIGHT?
Arrears are only paid to those who won the legal action against the institute, without there being any possibility of appeal. Only cases that have already become final, that is, there is no longer any way to discuss whether or not there is a right to that amount, become delayed.
HOW DO I KNOW WHAT DATE I WILL RECEIVE IT ON?
The date for payment of arrears depends on when the judge ordered the INSS to pay off the debt and when the action came to a complete end. Arrears of up to 60 minimum wages, called RPVs, are paid within two months after the judge's payment order. Higher amounts become court orders, which are paid only once a year.
HOW DO I KNOW IF IT’S AN RPV OR A PRECATORY?
RPVs are debts of up to 60 minimum wages paid more quickly. The legal deadline is up to 60 days to pay off the arrears. Federal court orders are debts above this amount, paid only once a year, according to the date the proposal was registered in the system, after the process has fully concluded and the judge gives the payment order.
When searching on the website of the responsible TRF, the acronym RPV will appear, for a small value request, or PRC, for precatório. In general, the insured already knows whether they will receive RPV or precatório before the end of the process, because the calculations are presented beforehand.
