The National Social Security Institute (INSS) promises to analyze, later this month, the stock of pension requests for children and adolescents who lost their mothers to feminicide. There are more than 400 applications stopped. From now on, the INSS says it will analyze the stock of requests and also new requests for the pension. The law that guarantees the benefit is from 2023, but there was a missing stage in the regulation of the law that created aid for these orphans. ? INSS began receiving requests in December 2025. But the ordinance with details of the process and criteria for applications to be analyzed by Social Security technicians was published at the end of May. ?? Who is entitled? The pension is intended for children who lost their mothers as victims of feminicide. The amount corresponds to one minimum wage per month and will be divided among dependents, if there is more than one beneficiary. Payment is guaranteed until the age of 18 and is directed to the legal guardian whose family income is up to R$405.25 per person — equivalent to a quarter of the minimum wage. Proof of the crime is made with documents from the police investigation or court decision on the case. Aid also extends to orphans of transgender women who are victims of femicide. To apply for the pension, the Single Registry (CadÚnico) must have been updated in the last two years and must contain the CPF of everyone in the family. How to request The request must be made by the legal representative of the child or adolescent, directly to the INSS, either at an agency, via the 135 telephone exchange or through the Meu INSS application. But the regulation – a step that details the procedures for paying the benefit – took more than two and a half years. First, a presidential decree was needed to regulate the law. The decree was published at the end of last year. From then on, the INSS began receiving pension applications. But another regulation was still missing: an INSS ordinance. This rule was only published at the end of May. In a statement, Palácio do Planalto said that, to prepare the decree, several ministries were involved and that “these definitions required in-depth studies and detailed technical analyses”. “Thus, the period that passed between the sanction of the law and the issuance of the regulatory decree corresponded to the time necessary for the careful treatment of the matter, to ensure the effectiveness and adequate implementation of the policy”, stated the government. The INSS said it needed time to prepare for the payment of a new type of aid. “Any new benefit requires a series of adaptations on the part of the institution”, he declared.
